Synopsis
The role of the architects has somewhat enlarged over the years and this has cause enormous stress and pressure. This in turn may cause architects to make mistakes and sometimes lose control. Architects are often named in disputes and may end in litigations as they are the obvious target due to their role in the project be it as contract administrator, the principal Submission Person, or the designer.
Professional Negligence is an emerging phenomena. It may sound astonishing, even ridiculous, but it is true’ Prof. Dato’ Dr Hussin Ab. Rahman.
There are 101 possible things that can go wrong in a project. Sometimes due to inexperienced staff or interference by clients. The laws do not necessary side us, in fact it impose on us a duty of care. When we take on a commission, the role starts on the very minute we are appointed and it ends many years later (hopefully).
This talk will discuss the impact on us based on my experience in courts and other tribunals. We will visit architects’ liabilities in the various phases of appointment, as the designer, as the contract administrator, as the certifier in the HDA Sales and Purchase Agreement, and in other various capacity. We hope this talk will provide an insight on the possible liabilities and the avoidance. Extract of cases will be discussed as illustration to give a clearer view on the subject of liabilities. Best practice will also be discussed.

Speakers Profile
Ar Steven Thang is a PAM council member and a practicing architect for 27 years. He represents PAM, in various capacity including chairman, in many SIRIM and CIDB technical committees. Ar Steven chairs the PAM ADR committee and the PAM contract review sub-committee. He is also a certified adjudicator, a certified building inspector and an Expert witness for many tribunals/courts cases.
